Oregon – Free Oregon, Inc. defends American civil liberties in Oregon by announcing its intent to launch, what is expected to be, the largest “Takings” case in state history. A “Taking” is when the government seizes personal property and does not compensate the citizen at fair market value. This unprecedented class-action lawsuit is against the State of Oregon on behalf of small business owners.
Free Oregon is seeking potential plaintiffs who are current or former small to medium sized business owners in Oregon whose businesses were either destroyed or significantly devalued as a direct result of COVID-19 regulations. The goals of the lawsuit are to:
1. Force the State of Oregon to compensate the businesses owners severely damaged by COVID-19 regulations, as entitled by law.
2. Expose motive, collusion and corruption in our state and local governments.
3. Set legal precedent to ensure this level of government overreach can never happen again.
Governor Kate Brown and the State of Oregon used COVID-19 regulations to target, destroy and devalue thousands of small to medium sized businesses in Oregon. This amounts to a “Taking” under the Fifth Amendment of the United States Constitution; especially under emergency order. After several weeks of planning, Free Oregon procured the top civil and property rights attorneys in the state of Oregon and now seeks potential plaintiffs.
Ben Edtl, Free Oregon’s Chief Executive Officer, who is also a potential plaintiff in the lawsuit, stated: “The government has been thoroughly weaponized against its own citizens. 90% of the workforce in the state of Oregon was employed by small businesses before the pandemic. This is also the largest tax base in the state of Oregon. The government has destroyed business assets and future earnings from thousands of individual business owners and must now be held accountable to compensate them according to law.” Ironically, this upper middle class tax base is also the most likely to donate to political candidates who are likely to object to additional government regulation, additional taxation and/or minimum wage increases regardless of political party. “These are the citizens who have the drive and ability to push back against an oppressive government, like the State of Oregon, that debilitates its hardest working people.”
“Specific businesses and individuals have been unjustly targeted. These orders have abused the public, creating unnecessary dependency on our local government to provide, rather than the free market. At its essence, the government has liquidated private resources and reinforced their agenda to increase social control through dependency on programs. Our state will bankrupt itself and our cities will continue to deteriorate when the largest paying tax base in the state is abused,” stated Angela Todd, Chief Communications Officer at Free Oregon, as well as, a Portland business owner.
Takings cases are quite common both in Oregon and throughout the United States. What’s uncommon, in this case, is the unprecedented scale at which this Taking occurred. Thousands of small business owners were forced into closure in Oregon, as a direct result of the States’ interference and therefore Free Oregon expects thousands of businesses to join this action.
