As the IFA staff prayed about the Texas law that took effect this week, we were struck by the power of some faithful people who believe in a big God and have done what people said could not be done.
A new Texas state law regulating abortion (Texas Heartbeat Act) was enacted in May 2021 to restrict abortions after six weeks. The limits on abortion are enforceable not by the state but through private litigation against those who aid and abet in an illegal abortion. Violators can be required to pay $10,000 to the person filing the suit.
Abortion providers sued to enjoin the law and obtained a stay. The Fifth Circuit lifted the stay, allowing the law going into effect.
The abortion providers asked the Supreme Court to overrule the Fifth Circuit, which it refused to do, by a vote of 5 to 4.
This was not a ruling on the merits, but on a procedural issue.
